READ CAREFULLY. By accessing or using PopaHO, you agree to be bound by these Terms. If you do not agree, do not use this Platform.

1. Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you and PopaHO governing your access to and use of popaho.com and all related services (the “Platform”). By using the Platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Platform after any modification constitutes your acceptance of the updated Terms. It is your responsibility to check this page periodically.

2. Description of Services

PopaHO is an independent review and rating platform that publishes user-generated reviews, editorial content, ratings, and comparisons of third-party dating websites and applications. We do not own, operate, or control any reviewed dating service.

3. Commercial Relationships & Advertising Disclosure

IMPORTANT DISCLOSURE: PopaHO is a commercially operated platform. Please read this section carefully.

3.1 Affiliate Links & Commissions

The Platform contains affiliate links. When you click an affiliate link and make a purchase, sign up, or take another qualifying action on a third-party dating site, we may receive a commission or other compensation from that site at no additional cost to you. We participate in affiliate programs including, but not limited to, direct dating site programs and third-party affiliate networks.

The presence of affiliate links does not obligate us to recommend, endorse, or favorably rate any particular service. However, you should be aware that affiliate relationships exist across the Platform.

3.2 Sponsored & Promoted Content

Certain dating sites, services, or content on the Platform may be featured, promoted, highlighted, ranked, or otherwise given preferential placement on a paid commercial basis (“Sponsored Content”). Sponsored Content may include:

“Featured” or “Sponsored” listings in review roundups or comparison tables
Promoted positions in search results or category rankings
Banner advertising, display ads, or native advertising placements
Co-branded content, sponsored reviews, or paid editorial features

Where content is sponsored, we will include a disclosure label such as “Sponsored”, “Advertisement”, “Promoted”, or similar designation. The format and placement of such labels is at our sole discretion.

3.3 Commercial Relationships May Influence Placement

You expressly acknowledge and agree that: (a) rankings, lists, ratings, and featured positions on the Platform may be influenced by commercial relationships, including affiliate agreements and paid promotion arrangements; (b) sites that compensate us may receive more prominent placement or favorable visibility; (c) PopaHO makes no representation that rankings or ratings are based solely on objective quality criteria.

Despite commercial relationships, we strive to provide useful information. However, we make no warranty that our content is unbiased, complete, or free from commercial influence.

3.4 No Endorsement

The inclusion of any dating site on the Platform does not constitute our endorsement of that site’s quality, safety, or suitability for your needs. Placement may be influenced by commercial factors. Always conduct your own research before using any dating service.

4. User Accounts

4.1 Registration

To submit reviews or comments, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. We may suspend or terminate accounts at our sole discretion without notice.

4.2 One Account per User

Creating multiple accounts to manipulate ratings, circumvent bans, or engage in deceptive practices is prohibited.

5. User-Generated Content

5.1 Content Standards

Reviews and comments must reflect genuine personal experience and must not be: false, fabricated, defamatory, harassing, discriminatory, sexually explicit, submitted on behalf of a dating company, or in violation of any law.

5.2 License Grant

By submitting content, you grant PopaHO a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, adapt, modify, publish, distribute, and display such content in any media, in connection with operating, promoting, or monetizing the Platform. You waive any moral rights in such content to the extent permitted by law.

5.3 Content Moderation

We reserve the right, but not the obligation, to review, edit, remove, or decline to publish any user content at our sole discretion, at any time, without notice or liability. We do not endorse any user-submitted content.

6. Prohibited Conduct

Using the Platform for any unlawful purpose
Scraping, crawling, or automated data extraction without written permission
Attempting to gain unauthorized access to our systems
Submitting false, fabricated, or paid reviews
Impersonating any person or entity
Interfering with the operation of the Platform
Harvesting user data for spam or unauthorized purposes

7. Intellectual Property

All proprietary Platform content — including editorial reviews, design, software, logos, and compilation of reviews — is owned by PopaHO or its licensors and protected by applicable intellectual property laws. You may not reproduce, republish, or commercially exploit our proprietary content without prior written consent. Limited personal, non-commercial use is permitted.

8. Third-Party Dating Services

Dating services reviewed on the Platform are independent third parties. We are not responsible for their practices, content, pricing, safety, or any harm resulting from your use of those services. Information about reviewed sites is based on publicly available data, affiliate materials, and user reports, and may not always be current or accurate. Always verify information independently before using any dating service.

9. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS. WE DO NOT WARRANT THAT REVIEWS, RATINGS, OR RANKINGS ARE ACCURATE, COMPLETE, UNBIASED, OR CURRENT. WE EXPRESSLY DISCLAIM ANY WARRANTY THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POPAHO AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM OR ANY CONTENT THEREON.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE PLATFORM SHALL NOT EXCEED USD $100. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH THE CLAIM IS BROUGHT AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain liability limitations; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless PopaHO and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your user-generated content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Modifications & Discontinuation of Service

We reserve the right to modify, suspend, or discontinue the Platform or any part of it at any time, with or without notice, and without liability to you. We may change features, remove content, or alter pricing (if applicable) at our sole discretion.

13. Termination

We may suspend or terminate your access to the Platform at any time, for any reason or no reason, without notice or liability. You may stop using the Platform at any time. Upon termination, all provisions that by their nature should survive will survive, including disclaimers, limitations of liability, indemnification, and governing law.

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles.

14.2 Informal Resolution

Before pursuing any formal legal action, you agree to contact us at support@popaho.com and provide us with a written description of the dispute. We will attempt to resolve the matter informally. If we cannot reach a resolution, either party may proceed to arbitration as described below.

14.3 Binding Arbitration

Any dispute, claim, or controversy arising from or related to these Terms or the Platform shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association, rather than in court. Arbitration shall take place in New York, NY. The arbitrator’s decision shall be final and binding.

Exceptions: Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

14.4 Class Action Waiver

YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. YOU WAIVE THE RIGHT TO TRIAL BY JURY AND TO PARTICIPATE IN CLASS ACTION LITIGATION.

15. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and PopaHO regarding the Platform.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
No Waiver: Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
Assignment: We may assign our rights under these Terms without restriction. You may not assign your rights without our written consent.
Force Majeure: We are not liable for failures caused by circumstances beyond our reasonable control.
No Agency: Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and PopaHO.
